  1. Introduction

    This Privacy Policy applies to the website at https://dev.rosalindfranklin.edu/preceptor-enhancement-program/ owned and operated by Rosalind Franklin University of Medicine and Science (referred to as “RFUMS”, “us”, “our” and “we”). RFUMS, which brings together five colleges and over 30 graduate health profession and science programs, focuses on team-based, interdisciplinary learning and practice opportunities, making it a leader in interprofessional healthcare education and research. In this capacity, RFUMS may create services such as this website to further its mission.

    This Policy describes how RFUMS collects and uses any personal information you provide on the website. It also describes the rights you have related to the personal information you have submitted.

    Our website may contain links to sites maintained by third parties. This Policy does not apply to your activities on those sites, any information you provide to those sites, or information that may be collected about you by those sites.

    By using our website to provide your personal information and obtain services, you agree to the terms of this Policy, including the transfer of personally identifiable information to the United States or another jurisdiction whose privacy laws may be different from those in your country. Furthermore, you acknowledge that the collection and processing of your personal information may be necessary for us to fulfill any obligations we have to you (e.g., you may have paid for services, and we need certain information about you to provide those services). Finally, you acknowledge that the collection and processing of your personal information satisfies a legitimate interest for RFUMS to prepare practicing health care workers to be high-quality educators. Our legitimate interest will not override any rights you have related to your data as described in this Policy.
  2. Definitions

    We use the following terms frequently in this Policy:
    • Data Record: The collection of data, other than system data (e.g., user ID, password, log files), related to a specific individual.
    • Record Holder: The person who owns and is referenced in a Data Record.
    • User Account or Account: the information and settings used to access the website and control the user interface or services (e.g., user ID, password, screen layout, notification settings)
  3. Information Collected and How We Obtain It

    RFUMS collects information from Record Holders by:
    1. Obtaining information directly from you on this website;

      To use certain features of the website, users must create a Data Record. The Data Record requires personal information such as name, email address, academic credentials, and professional background. You are not required to create a Data Record to access the website; however, if you do not, certain features (e.g., certification of program completion) are not available.

      If you want to create a Data Record, the website requires you to provide RFUMS with personal information, including, name and email address.
    2. Obtaining information directly from you through other RFUMS relationships;

      You may have been referred to this website because you already have a relationship with RFUMS. For example, you may hold a faculty appointment with RFUMS. We may utilize information gathered through other relationships with you to better understand and improve our operations.

      We also collect information from you if you contact the Help Desk, website administrator, or Program administrator. For example, we may ask for a preferred phone number or email address to contact you in response to an inquiry. RFUMS may associate your Data Record with these activities.
    3. Obtaining information from website utilization;

      RFUMS will collect information about your use of the website to assist with the ongoing operations of the service. We may monitor traffic to prevent abuse of the service, ensure adequacy of resources to address service demand, and provide optimal organization of website information. RFUMS may also utilize analytics tools on collected information (e.g., IP address, browser type and version, type of device being used, and pages visited) to assist with our service optimization efforts. We may combine this automatically collected log information with other information we collect about you.

      We may utilize cookies or similar tracking technologies to analyze trends, administer the website, track users’ movements around the website and to gather demographic information about our users. We may also use cookies to remember users’ settings such as language or display preferences. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our website, but your ability to use some features or areas of our site may be limited.

      Only our staff, and our agents’ or contractors’ staff, with a “need to know” to manage the website and process data for us.
  4. How We Use Information

    We use the information we collect to provide the RFUMS website to the public and to Record Holders. For example,

    We use the information we collect to operate, protect, evaluate and improve the RFUMS website, its features, and our operations in general.

    We may also use this information to contact you. We send information either to the email address or phone number you have provided us. Reasons we may contact you include:
    • Your routine use of the website. For example, the website may email certificates of completion, send email account verification messages, or send password reset information when initiated by you.
    • Informational messages related to the website. For example, we may make significant changes to the contents or functions of the website that we believe you should know about. RFUMS will make every effort to reduce these messages to only those that have a fundamental impact on your use of the website
    • Service messages related to your Data Record, including, without limitation: changes to our Privacy Policy or functionality that affects how a user manages privacy; changes to Terms and Conditions; changes to registration procedures or fields included; changes in the type of information collected. As this information may affect your visibility (privacy) settings and the functioning of your ORCID account, you may not opt-out of service messages.
    • We may contact you to send you newsletters, and information about RFUMS. You may subscribe or unsubscribe at pep@rosalindfranklin.edu, by changing your email preferences in your Account Settings, or by clicking on the unsubscribe message included in each newsletter.
  5. How We Share Information

    Except as set forth in this in this Policy or as required by law, RFUMS does not share any non-public information about you with other parties. We do not share or sell your information to marketers, advertisers or other entities.

    We may share your information with agents or contractors (for example, a vendor may host RFUMS servers, or a 3rd party analytics tool may process log data), but only on a “need to know” basis to help us operate website and services, and only if the vendor agrees to maintain the confidentiality and security of your information and not use it for other purposes. These vendors are authorized to use your personally identifiable information only as necessary to provide these services to us.

    If we are required by law, public safety or public policy, or we are served with a warrant, court order, or subpoena, we may provide your information to regulators, enforcement agents, courts and/or other government entities. To protect your privacy interests, RFUMS will provide the minimal amount of data necessary to address the situation. To the extent allowed, we will promptly notify Record Holders about any government data requests that impact their Data Records.

    We may share aggregated, or summarized, usage data with the public so they can understand how the website is being used. We will only do so in a way that your personal identity is protected.

    We may provide your information if we need to defend against legal claims or in bankruptcy proceedings. To the extent allowed, we will minimize the amount of data disclosed and promptly provide notice about any such disclosures.

    If RFUMS is involved in a merger, consolidation, acquisition, asset sale or other restructuring, we will provide Record Holders a notice of how their Data Record and privacy may be impacted. Record Holders will be advised in advance and retain the data rights described in this Policy (e.g., the right to remove your data) prior to the completion of the restructuring.
  6. Access, Review, Editing, Modifying and Deleting Data

    The website may allow you to review, delete, and edit information in your Data Record. In the event that you are unable to perform these actions, you may request them through the designated contact (See Section XVI). If you discover that you accidentally have more than one Data Record, you may request to have the records combined.

    In limited circumstances, RFUMS may proactively correct data in a Data Record where errors are a result of system errors or other obvious errors not caused by you. To ensure transparency of our processes, we will post information on the website when we make such changes.

    You may ask us to remove your personal information (also known as “the Right to be Forgotten”) from the website. RFUMS may be required to keep a history of your activities as part of your educational record if your activities were related to an academic achievement (e.g., certificate or degree program), or employment requirement (i.e., training is required to fulfill your role with RFUMS). If history needs to be retained, your personal information will be removed from the website, and your achievements will be recorded in the appropriate (academic or personnel) database. We will advise you of this in response to your request and provide additional details as requested.
  7.  Records of Deceased Persons

    A Data Record of a person that was created before the person deceased is maintained as is for the purpose of continued data integrity and historical website utilization statistics. RFUMS will make every effort to proactively remove contact information from the deceased person’s record if it becomes aware of such an event. A person who has assumed management of the deceased Record Holder's email address, phone number, or other primary contact information may request that all communication from RFUMS to the individual be disabled.

    If RFUMS is contacted to remove or correct a Data Record for someone who is deceased, the request will be handled according to RFUMS’s established Dispute Procedure described in Section IX.
  8.   Automated Processes

    RFUMS may use automated processes to make decisions on data that you submit. For example, you may be required to pass a multiple choice quiz to validate your understanding of training materials, and a certificate of completion is dependent on a satisfactory score on the quiz. In this example, an automated process will evaluate your quiz responses against the correct answers to determine if the score is satisfactory.

    If you have any concerns related to the accuracy of automated processes, you may submit a request to review the process and its results. The request will be handled according to RFUMS’s established Dispute Procedure described in Section IX.
  9. Transparency, Disputed Records, & Removal of Data

    Upon request, RFUMS will provide you with information about whether we hold any of your personal information. If you have a concern about the accuracy of data in your Data Record, you may request to correct, update, amend, delete, or remove it. Upon request, we will provide you with a copy of your data in a comma delimited file.

    If you have any concerns about your Data Record, you can request that we stop all processing of your personal data until your concerns are addressed.

    RFUMS reserves the right to remove from its website and servers any Data Record that violates the privacy, publicity or other rights of any person, is the subject of a dispute, or for any other good cause, including without limitation, in any situation in which RFUMS is advised by legal counsel that the retention of such data poses a legal risk.

    We will retain your information for as long as your Account is active, or as needed to provide you services, including reactivation. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
  10. Information Security

    We are committed to protecting our users from unauthorized access to or unauthorized alteration, disclosure or destruction of personal information contained in the website or which we otherwise hold. Your information will be stored in a data center with restricted access, and we will utilize a variety of technical security measures to secure your data. Transport Layer Security (TLS) technology is used to encrypt data between you and our servers. Intrusion detection and virus protection software is also utilized to maintain data integrity.

    We restrict access to information to RFUMS employees, contractors and agents who need to know that information to manage the website and process such data for us, and who are subject to confidentiality obligations.

    Despite these measures, we cannot guarantee that unauthorized persons will not be able to hack our system or otherwise defeat our security measures.

    Your access to some of our services and content may be password protected. To maintain the security of your information, please keep your username(s) and password(s) strictly confidential and do not disclose them to anyone. We also recommend that you sign out at the end of each session and close your browser window when you have finished your work. You will be solely responsible for any action, activities, and access to our website that were taken through your username and password, and that occurred before you notified us of their loss. If you have any questions about the security on our website, please contact us (See Section 18).
  11. International Data Transfer

    Note that we may store and process personal information on servers located outside of the country where you originally deposited the data. The data protection laws of the country or countries where this personal information will be stored or processed might not be as comprehensive as those in your country. Regardless of where we store and process data, we take steps to protect your information, consistent with the principles set forth in this Policy, which are intended to comply with the Privacy Shield Framework issued by the U.S. Department of Commerce and with Article 26 of the EU Data Protection Directive covering data transfers. Additionally, we have thoroughly reviewed our privacy practices and procedures with the European General Data Protection Regulation (GDPR).

    By using our website, you agree that (i) your personal information may be transferred to our facilities and those of the third parties with whom we share it as described in this Policy and (ii) any claims of any kind that you have regarding this Policy and our use and sharing of data shall be resolved in accordance with the procedures set forth in Section 13.
  12.   Enforcement and Arbitration; Governing Law

    If you have any concerns or claims with respect to our Policy, please contact us (See Section 18). We will investigate and attempt to resolve any complaints and disputes regarding our use and disclosure of personal information.

    If you are not able to resolve your concerns through RFUMS’s internal mechanism, arbitration as set forth in this paragraph will be your final and exclusive recourse for dispute resolution. If arbitration is necessary, it will be conducted by telephone and email, and if it must be done in person, it will be conducted in North Chicago, IL, and by using our website, you consent to such jurisdiction. The arbitration will be conducted by one arbitrator who is a member of the American Arbitration Association, and under the rules of commercial arbitration of the American Arbitration Association. Both parties will bear equally the cost of arbitration (exclusive of legal fees and expenses). All decisions of the arbitrator(s) will be final and binding on both parties and enforceable in any court of competent jurisdiction.

    This Privacy Policy is governed by and any disputes shall be resolved under the laws of the State of Illinois (United States), without giving effect to its conflict of laws principles.
  13.   Children's Privacy

    RFUMS provides this website for specific business-related purposes and does not offer services directed to children. Should a child whom we know to be under 13 send personal information to us, we will delete that information immediately. Parents may also contact us (See Section XVI) to request removal of any personal information about a minor.
  14.   Public Areas

    Our website may offer publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from a blog or community forum, contact us (See Section XVI).
  15.  Changes to this Policy

    We may change our Privacy Policy from time to time. We will post any changes to this Policy on this page. Your continued use of the website will be deemed conclusive acceptance of modifications. Please reference this page regularly to check for Policy changes. We will not reduce your rights under this Policy with respect to data previously deposited without your consent. If, in our discretion, we think that any changes are significant, we will take additional steps to inform you by posting a notice of changes on our website homepage and/or by sending you an email to inform of such changes prior to the change becoming effective. In such a case, we will attempt to obtain your consent through an opt-in mechanism such as an “agree” checkbox the next time you log in or an “I consent” button in an email.
